At Spectrum Whisper LLC, we strive to deliver high-quality software development services that meet your expectations. This Refund Policy outlines the terms and conditions for refunds and cancellations.
1. Digital Services Nature
Please note that software development is a custom service industry. Once work begins, time, expertise, and resources are invested into your project. As such, our refund policy differs from retail or physical product purchases.
2. Refund Eligibility
Refunds may be considered under the following circumstances:
- Before Work Begins: Full refund if requested before project initiation
- Service Not Delivered: If we fail to deliver agreed-upon services within reasonable timeframe
- Breach of Contract: If we materially breach the terms of our service agreement
- Significant Deviation: If delivered work substantially differs from agreed specifications
Non-Refundable: Once project work has begun and deliverables have been provided, refunds are generally not available unless the circumstances listed above apply.
3. Refund Process
To request a refund, please follow these steps:
- Send a written request to contact@spectrumwhisper.com
- Include your project details, invoice number, and reason for refund
- Allow up to 14 business days for processing and response
We will review your request and respond in writing. If approved, refunds will be processed using the same payment method used for the original purchase. Processing time may vary depending on your financial institution.
4. Cancellation Policy
Clients may cancel projects under the following terms:
- Before Work Begins: Full refund, minus any administrative fees (maximum 5%)
- During Development: Pro-rated refund based on work completed and time invested, plus applicable project termination fee (up to 20%)
- After Delivery: No refunds, except in cases of significant deviation or breach as outlined above
5. Dispute Resolution
If you have concerns about our services or believe we have not met our obligations:
- Contact us immediately to discuss your concerns
- We will work in good faith to resolve any issues
- Additional work may be required at no extra cost to meet agreed specifications
- If resolution cannot be reached, the matter will be governed by New Mexico law
Customer Satisfaction: Our goal is your satisfaction. We encourage open communication throughout projects to ensure deliverables meet your expectations.
6. Subscription Services
For ongoing subscription services or maintenance plans:
- You may cancel at any time with 30 days written notice
- Refunds for prepaid periods are not provided, but service continues through the paid period
- Cancellation takes effect at the end of the current billing cycle
7. Force Majeure
We are not liable for any delay or failure to provide services due to circumstances beyond our reasonable control, including but not limited to acts of God, war, strikes, or government regulations. In such circumstances, we will make reasonable efforts to resume services as soon as practicable.
8. Changes to This Policy
We reserve the right to modify this Refund Policy at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified policy.
9. Payment Disputes
If you initiate a payment dispute with your financial institution before contacting us:
- Please first attempt to resolve the issue directly with us
- We provide documentation and assistance in resolving disputes
- Chargebacks may affect your ability to use our services in the future
